Arizona CDL DUI Rules: What Commercial Drivers Face

For commercial drivers, a DUI does not just threaten a license — it threatens a livelihood. Arizona follows federal rules for commercial driver's licenses, and those rules are far stricter than the ones for regular drivers. The margin for error is essentially zero.

The headline number is 0.04. While operating a commercial vehicle, a CDL holder can be charged at half the standard 0.08 BAC threshold. But the stricter standard does not stop at the commercial vehicle. A DUI conviction in a personal car counts too: under federal regulations adopted by Arizona, a first DUI conviction disqualifies a driver from holding a CDL for one year. A second brings a lifetime disqualification. For drivers hauling hazardous materials, a first offense can mean a three-year disqualification.

Disqualification is different from suspension. It means the commercial privileges are gone for the set period, and there is no restricted or hardship CDL to fall back on — federal law prohibits issuing a commercial license with an interlock workaround the way Arizona does for regular licenses. Many employers also have their own policies that go beyond the legal minimums, and a DUI arrest alone, before any conviction, can trigger termination under company rules.

The testing and enforcement side is strict as well. Commercial drivers are subject to employer drug and alcohol testing programs under federal motor carrier rules, on top of ordinary roadside enforcement. Refusing a chemical test after a DUI arrest carries the same implied-consent license consequences as for any driver, plus the separate CDL disqualification track. In practical terms, a truck driver facing a DUI in Arizona risks the regular license and the commercial credential at the same time.
