DUI-Related Car Accidents in Arizona

Crashes involving impaired drivers are among the most serious car accident cases in Arizona. Alcohol and drug impairment slows reaction time, impairs judgment, and reduces coordination, which is a dangerous combination at highway speeds. Arizona has some of the strictest DUI laws in the country, and those laws cast a long shadow over the civil claims that follow an impaired-driving crash.

When a drunk driver causes a collision, two separate legal tracks typically run in parallel. The criminal track involves prosecution by the state, with penalties that can include jail time, fines, license suspension, and ignition interlock requirements. The civil track involves the injured person's claim for compensation covering medical bills, lost wages, vehicle damage, and other losses. The two tracks are independent: a criminal case can end in acquittal while a civil claim proceeds, or vice versa, because they use different standards of proof.

Evidence of impairment often plays a central role in the civil claim. Police reports noting field sobriety tests, breath or blood test results, and observations of slurred speech or the odor of alcohol all become part of the record. Insurance companies defending the impaired driver face an uphill battle on fault, though disputes over the extent of injuries and the value of the claim can still arise.

Arizona also recognizes dram shop liability in limited circumstances, meaning a bar or restaurant that served alcohol to an obviously intoxicated person can sometimes share responsibility for a resulting crash. These claims have specific legal requirements and are fact-intensive.

Insurance complications are common in DUI crashes. Some policies contain exclusions related to intentional acts or criminal conduct, and coverage disputes can emerge. When the impaired driver is uninsured or underinsured, the victim's own UM or UIM coverage may come into play, just as in other serious crashes.

The injuries in DUI-related collisions tend to be severe, partly because impaired drivers often fail to brake before impact.
