Wrongful Death Claims After a Fatal Plane Crash

When a fatal plane crash takes a life, the surviving family members may have the right to bring a wrongful death claim. This area of law exists to provide compensation to the people left behind — and while no amount of money replaces a loved one, these claims can cover the very real financial and emotional losses a death causes.

In Arizona, wrongful death claims can generally be brought by the surviving spouse, children, or parents of the person who died. The law also allows the personal representative of the deceased person's estate to bring the claim on behalf of those beneficiaries.

The damages available in a wrongful death case can include funeral and burial expenses, medical costs from the accident, the lost income and financial support the deceased would have provided, and compensation for loss of companionship, care, and guidance. In cases involving particularly reckless conduct, punitive damages may also be possible, though these are harder to obtain.

Wrongful death cases arising from an aviation accident have some distinctive features. There may be multiple defendants — the pilot, the operator, the maintenance company, the manufacturer — and each may point the finger at the others. The NTSB investigation, which can take a year or more, often provides the factual foundation. Because aviation is federally regulated, federal law can affect where the case is filed and which rules apply.

Arizona also has a statute of limitations for wrongful death claims, which sets a deadline for filing. Missing that deadline can mean losing the right to bring the claim entirely, so families are generally encouraged to understand their options early.

These cases are emotionally difficult and legally complex, involving grief alongside technical investigation. A personal injury attorney experienced in aviation matters can explain how the process works and what to expect. Find a qualified attorney at Justice Lookup.
