Common questions

What if the seller hid defects?

Most states require sellers to disclose known material defects. If a seller concealed a problem, the buyer may have claims for damages or rescission — but proving the seller knew is often the hard part.

Can I get my earnest money back?

It depends on the contract’s contingencies. Inspection, financing, and appraisal contingencies usually protect the deposit; backing out without a valid contingency can forfeit it.

What happens if the closing is delayed?

Contracts usually set a closing date with remedies for delay. If one side cannot close, the other may be able to cancel, keep the deposit, or sue for damages depending on the terms.

What should I bring to a consultation?

Bring the purchase agreement, inspection reports, the seller’s disclosure statement, all correspondence between the parties and agents, and closing documents if the sale completed.
